Despite good intensions, employee resource groups (aka “affinity groups” or “employee networks”) can create various legal issues and risks with respect to how ERGs are formed and operated.  This presentation will provide an overview of key Title VII, EO 11246, NLRA, FLSA and other compliance issues created by ERGs and suggested policies / practices to control liability exposure.  Objectives: (1) Gaining an understanding of potential reverse discrimination, NLRA unfair labor practice, FLSA wage and hour, and other claims that can arise from ERGs; (2) Learning key models for ERG design and related legal pros / cons; and (3) Identifying practical take-aways for use in updating ERG policies, guidelines and other materials.
