John Fox is an employment lawyer with Fox, Wang & Morgan. He practices nationwide and advises companies in employment compliance matters. He previously served as the Executive Director (now renamed “Deputy Director”) to OFCCP Director Ellen Shong Bergman (the first female OFCCP Director). John defended the largest lawsuit OFCCP has ever brought against a contractor. John has also defended more OFCCP Complaints filed in the Courts than any other living or retired lawyer. Despite having spent over 400 days in trial in his career, John views himself as trainer and writer. John co-authored (with David A. Copus, former Director of the EEOC’s first Systemic Discrimination Unit) the first book in the country describing how to develop Affirmative Action Plans, now in its 38th Edition. John is also one of the three authors (along with Candee Chambers and Jen Polcer) of the DirectEmployers Week In Review. The “WIR” has become the main channel of communication about OFCCP and EEO matters with over 7,000 subscribers and over 20,000 content reads per month. JDSupra presented John with its “Readers Choice Top Author” award for 2021 (from among 19,000 other writers on compliance and contracting matters).

Plenary Session: Recent Significant OFCCP Policy Developments

During this session participants will learn about OFCCP policy developments, including failure-to-hire, compensation and affirmative action claims arising in OFCCP audits. Presenters will also discuss how the new American Community Survey census data can negatively impact contractors and how to avoid its effects on AAPs. Participants will have many “learning moments” and leave the conversation with practical tips to apply when developing AAPs and defending OFCCP audits considering current OFCCP policy initiatives.
